Terms of Sale
64-40 Auto Salvage will fulfill your order after you review and accept the Terms of Sale. You must indicate your acceptance of the Terms Of Sale in order for us to begin processing your order. Your order of any part through constitutes your acknowledgement of and agreement to the following terms and conditions:
1. Sole Terms and Conditions. These terms and conditions constitute all of the terms and conditions of the purchase and sale made through this Internet site for customers located in the United States. They apply to all orders and there are no deviations. For customers located outside the continental United States, in addition to these terms and conditions, contact a customer service representative for applicable freight charges.
2. Ordering. Your order must include your name, full billing and mailing addresses and other specific shipping instructions. Your order must also specify the correct information needed to order the correct part for your vehicle. Failure to complete this information accurately may result in shipment of the wrong parts. Any additional shipping charges necessary to correct such an error shall be at your sole risk and expense. There will be a 2.5% EPA charge on all purchases.
3. Payment Methods. 64-40 Auto Salvage, accepts MASTER CARD, VISA, AMERICAN EXPRESS, and DISCOVER. We also accept personal checks ( part will be held till cleared) and money orders. You must include name, payment method, credit card billing address, account number and expiration date. No C.O.D.s will be accepted.
4. Commercial Accounts. If you are a commercial enterprise, you may establish an account with 64-40 Auto Salvage Simply call us at the number listed below. For purchases on account, our terms are Net 30 days from the date of the invoice. We will charge you interest at the rate of one and one-half percent (1½%) per month on the total invoice charge not paid when due.
5. Security. If you are a commercial customer, you shall be solely responsible for security for, and any unauthorized use of your account. We suggest you use purchase orders or specify a call back verification of your purchase. Whether an individual or commercial customer, if you suspect wrongful use of your user identification number or credit card, notify us immediately so that we can put your account on hold.
6. Sales Tax. Because 64-40 Auto Salvage, is located in the State of Arkansas, it charges Arkansas sales tax for delivery of parts within Arkansas. Arkansas customers who provide us with a Tax Exemption Certificate will not be charged the Arkansas sales tax on their orders.
7. Shipping & Risk of Loss. Your order will be shipped F.O.B. Pottsville Arkansas, and the costs of shipping will be added to your purchase and included on your invoice. You bear the risk of any loss or damage during shipment if it is shipped other than UPS. Check with us prior to purchase for type of shipping required for your order.
8. Warranties. Subject to the limitations set forth below, 64-40 Auto Salvage, expressly warrants 90 days the merchantability of the part as specifically described on the invoice accompanying such part. An extended warrantee of 6 months and 1 year available on most instock parts. If we have located the part (special orderd) from another salvage yard, the warrantee of the providing salvage yard will be the total extent of the warrantee and all other warrantee's will be void. Please ask for the specified warrantee on special ordered parts.
The following limitations apply to certain instock parts:
a. Air Conditioning Parts. The warranty on any air conditioning part is limited to a period of ninety (90) days, and only if a new receiver dryer and expansion valve are installed at the same time as the warranted part. Only the cost of the air conditioning part is covered by the warranty. Loss of refrigerant due to part failure is not covered.
b. Cylinder Heads. The warranty for cylinder heads covers the body of the cylinder head only from being warped excessively (meaning more than can be planed by machine shop) or cracked. 64-40 Auto Salvage, disclaims all other warranties for cylinder heads and all warranties for cams, valves, seals, gaskets, rockers and any other attachment. Cylinder heads must be machined and pressure tested before installation or the warranty is voided.
c. Engines. Engines are guaranteed against knock, excessive smoke and oil consumption (2qts/1000 miles), inadequate oil pressure, turned bearings, and cracks in heads, block, or pistons. Oil/fluid leaks, loose timing chains/belts, fuel components, tune ups, waterpump, distributors, engine cooling systems, and exhaust manifolds are not covered by this warranty. In order to make a warranty claim on an engine, you must provide a record of the date installed, type of vehicle installed in, mileage, and engine number. In addition, failure to do any of the following things voids the warranty. (i) Install a new timing belt, water pump, and thermostat at the same time the engine is installed. (ii) Change the oil filter and oil prior to starting the engine, change the oil after the first 600 miles, and change the oil once every 3000 miles thereafter. (iii) Make sure the heat tab is not melted or missing. (iv) Flow-check the radiator and repair it if necessary. (v) All HONDAS must have the oil screen and pickup tube cleared. (vi) Front and rear crank seals must be replaced.
d. Long Block Assemblies (Engines), Transmissions, Axle Assemblies, Anti-Lock Brake Assemblies, and Transfer Cases. The warranty for long block assemblies, transmissions, axle assemblies, anti-lock brake assemblies, and transfer cases does not extend to any attachment that is not separately identified and listed on the invoice. By way of example only, attachments include water pump, carburetors, starters, air conditioning compressors, fuel injection systems, throw out bearings, clutches, clutch forks, slave cylinders, etc. All unlisted attachments are sold AS IS.
e. Transmissions. Transmissions are guaranteed to be in good working order at the time of sale. Warranty covers slippage, and shifting failures. Breaking or shearing of teeth in manual transmissions is not covered by this warranty under any circumstances. Transmissions must be drained, flushed, and filled with factory recommended fluids. All external seals and internal filters must be replaced at the time of installation. The radiator must be flow checked and repaired/replaced at the time of installation. All Mazda and Mitsubishi automatic transmissions must have a secondary transmission cooling system installed for warranty to be valid. All automatic overdrive transmissions must be installed by an A.S.E. certified mechanic for warranty to be valid. Customer is required to show proof of installation by an A.S.E. mechanic for any claims to be valid. Failure to do any of the above voids the warranty.
f. All Other Parts. All other parts sold by 64-40 Auto Salvage are guaranteed to be in working order at time of installation. If you feel that you have discovered a defective part, contact 64-40 Auto Salvage immediately. 64-40 Auto Salvage's warranty covers normal on-road use only. If the vehicle into which a part is installed is used primarily off-road or is ever raced, the warranty is voided. In that case, the only warranty made by 64-40 Auto Salvage is that the part will operate at the time of installation. The addition of after-market parts or accessories voids the warranties for all parts on the vehicle. Failures of parts due to improper installation (i.e. not in accordance with O.E.M. specifications), accident, misuse, over-heating, or improper maintenance are not covered by this warranty. Proof of proper installation and maintenance will be required to validate any warranty claims and is the purchaser's responsibility to provide when the warranty is claimed. Not having proof may result in voiding of the warranty or denial of your warranty claim.
9. Limitation of Remedies. AS YOUR SOLE AND EXCLUSIVE REMEDY FOR THE BREACH OF THE WARRANTY DESCRIBED ABOVE, 64-40 AUTO SALVAGE, WILL REPLACE ANY DEFECTIVE PART WITHOUT ADDITIONAL COST TO YOU. 64-40 AUTO SALVAGE, SHALL NOT BE LIABLE FOR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGE TO OR THE COST OF RELATED PARTS. You must call or write to 64-40 Auto Salvage, before returning such part in order for 64-40 Auto Salvage, to pay the return shipping charges.
10. Returns and Exchanges. You must notify 64-40 Auto Salvage, by mail or telephone before you return a part for any reason, whether or not it is a warranty reason. If you return a part without the consent of 64-40 Auto Salvage, you will not receive a refund. All returns must be accompanied by a copy of the original invoice and a letter of instructions. 64-40 Auto Salvage, will only pay return shipping only for warranty returns and only if 64-40 Auto Salvage, dispatches a carrier. No returns for non-warranty reasons will be accepted more than thirty (30) days after delivery to you. If you return a part for a non-warranty reason, you will be charged a twenty-five percent (25%) restocking fee in addition to the shipping costs for delivery and return. Cores are due within 30 days of receipt for a core refund.
11. Applicable Law. Your order shall be deemed to be accepted in the State of Arkansas by 64-40 Auto Salvage, upon the shipment of your order, and the contract thereby made shall be governed by and construed under the laws of the State of Arkansas without regard to its conflict of laws rules. Your visit to this site shall be deemed to occur within the State of Arkansas.
